1. Agreement
These Terms & Conditions (“Terms”) form an agreement between you and BFG Digital (“we”, “us”, or “our”). If you do not agree, please do not use our websites or services. Additional project-specific terms may apply when you engage us for paid work; those terms take precedence where they conflict with these general Terms.
2. Our services
We offer digital strategy, design, development, automation and related consulting services. Descriptions on our websites are for general information. Specific deliverables, timelines and fees are agreed separately in proposals, statements of work or contracts.
3. Use of our websites
You agree to use our websites only for lawful purposes. You must not:
- Attempt to gain unauthorised access to our systems or data
- Interfere with or disrupt the operation of our sites
- Use automated means to scrape or harvest content without permission
- Transmit malware, spam or harmful content
- Misrepresent your identity or affiliation
4. Accounts and enquiries
When you submit forms, book calls or otherwise contact us, you confirm that the information you provide is accurate and that you are authorised to provide it. You are responsible for keeping any login credentials confidential if we provide you with access to tools or portals.
5. Intellectual property
Unless otherwise agreed in writing, all content on our websites — including text, graphics, logos, designs and software — is owned by BFG Digital or our licensors and is protected by intellectual property laws. You may not copy, modify, distribute or create derivative works from our content without prior written consent.
For client projects, ownership of deliverables is governed by the applicable service agreement. Until full payment is received, we retain all rights in work product we create.
6. Third-party services and links
Our sites and services may link to or integrate with third-party tools (for example analytics, advertising, scheduling, messaging or payment platforms). We are not responsible for third-party content, policies or practices. Your use of those services is subject to their own terms.
7. Fees and payment
Fees for paid services are set out in the relevant proposal or contract. Unless stated otherwise, invoices are due as specified, and we may pause or withhold deliverables if payment is overdue. Setup fees and one-time charges are generally non-refundable once work has begun, except where required by law or expressly agreed in writing.
8. Disclaimers
Our websites and publicly available materials are provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose or non-infringement. We do not guarantee uninterrupted or error-free access, or that our services will achieve any particular business result.
9. Limitation of liability
To the fullest extent permitted by law, BFG Digital and its directors, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising from your use of our websites or services. Our total liability for any claim relating to these Terms or our services is limited to the fees you paid us for the specific services giving rise to the claim in the twelve months preceding the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
10. Indemnity
You agree to indemnify and hold harmless BFG Digital from claims, losses and expenses (including reasonable legal fees) arising from your misuse of our services, your breach of these Terms, or your violation of any law or third-party rights.
11. Privacy
How we handle personal information is described in our Privacy Policy. By using our services, you acknowledge that policy.
12. Changes
We may update these Terms from time to time. The “Last updated” date will reflect changes. Continued use of our websites or services after updates constitutes acceptance of the revised Terms, where permitted by law.
13. Governing law
These Terms are governed by the laws of Northern Ireland / the United Kingdom, without regard to conflict-of-law rules. Courts in that jurisdiction shall have exclusive jurisdiction over disputes, subject to any mandatory consumer protections that apply where you live.
